Rug Charity Auction — Terms and Conditions

Thank you for taking part in our charity auction, celebrating exceptional design in support of a meaningful cause.

These Terms and Conditions apply to your participation in the online auction of the rug described on the auction website (the Auction). By registering to participate or placing a bid, you agree to be bound by these Terms and Conditions.

Please read them carefully before placing a bid.

1. The Auction

The Auction will be conducted exclusively online through our website.

  • Bidding opens: 15 September 2026
  • Bidding closes: 15 October 2026 at 10:00 PM

All times are based on the local time displayed on the Auction website.

The Auction relates to the specific rug described and pictured on the Auction listing. Details including dimensions, materials, design and other relevant specifications will be provided on the listing.

We reserve the right to amend, suspend, extend or cancel the Auction where reasonably necessary, including where technical issues, circumstances beyond our reasonable control or other unforeseen circumstances materially affect the Auction.

2. Reserve Price

A reserve price of $10,000 AUD applies to the Auction.

The rug will only be sold if the highest valid bid at the close of the Auction meets or exceeds the reserve price.

If the reserve price is not met, no sale will take place and bidders will have no obligation to purchase the rug.

3. Charity Donation

The Auction is being conducted in support of charity.

Following completion of the sale, the proceeds available for donation will be calculated from the successful winning bid after deduction of associated costs relating to the Auction and rug, with such associated costs not exceeding 20% of the final winning bid.

The remaining amount will be donated to the charity partnered with the rug purchased.

The donation will be made following receipt of full payment for the rug and completion of any necessary verification or administrative requirements.

4. Eligibility to Bid

To participate in the Auction, you must:

  • be at least 18 years of age;
  • provide accurate and complete registration and contact information;
  • have the legal capacity to enter into a binding agreement; and
  • comply with these Terms and Conditions.

We reserve the right to refuse or cancel registration where we reasonably believe that a bidder has provided inaccurate information, attempted to manipulate the Auction, breached these Terms and Conditions or otherwise acted improperly.

5. Placing a Bid

All bids must be submitted through the Auction website.

The minimum bid increment will be displayed on the Auction website and each new bid must meet the applicable minimum increment.

By submitting a bid, you acknowledge that:

  • your bid is a firm commitment to purchase the rug at that amount if you are the successful bidder;
  • you are responsible for ensuring that the bid amount entered is correct before submitting your bid; and
  • bids cannot be withdrawn or cancelled once submitted, except where required by law or at our discretion in exceptional circumstances.

You should carefully check the bid amount before confirming your bid.

6. Auction Closing

The Auction will close at 10:00 PM on 15 October 2026, subject to any extension or suspension determined by us in accordance with these Terms and Conditions.

Bids received after the official closing time will not be accepted.

We reserve the right to extend or otherwise adjust the closing time where a technical issue or other circumstance materially interferes with the proper conduct of the Auction.

Our electronic records of bids and their timestamps will be used to determine the order and validity of bids, subject to any rights you may have under applicable law.

7. Determining the Winner

Subject to the reserve price being met, the bidder with the highest valid bid at the close of the Auction will be the successful bidder.

The successful bidder will be notified by email within 3 business days of the Auction closing.

If the successful bidder does not respond or complete payment within the required period, we may, at our discretion, cancel the sale and offer the rug to the next highest eligible bidder.

Any subsequent sale will remain subject to the reserve price and these Terms and Conditions.

8. Payment

The successful bidder must pay the full winning bid amount within 7 days of receiving notification that they have won the Auction.

The payment methods available will be communicated to the successful bidder following the Auction.

All bid amounts are inclusive of GST.

If payment is not received within the required period, we may cancel the sale and offer the rug to another eligible bidder.

9. Delivery and Shipping

Delivery within Australia is complimentary.

Delivery will be arranged by us following receipt and clearance of full payment.

For delivery to locations outside Australia, international shipping will be arranged at the successful bidder's expense. The applicable international delivery fee will be confirmed with the successful bidder following the Auction and must be paid prior to dispatch.

The successful bidder is responsible for any applicable international duties, customs charges, taxes, import fees or other charges imposed by the destination country.

We will take reasonable care in preparing and packaging the rug for delivery.

Any estimated delivery timeframe provided is an estimate only and may be affected by circumstances outside our reasonable control.

Nothing in these Terms and Conditions excludes or limits any rights you may have under the Australian Consumer Law or other applicable legislation.

10. Condition and Description of the Rug

The rug is a bespoke, handmade piece and may contain natural variations in colour, texture, pattern and finish.

Such variations are characteristic of handmade rugs and should not, of themselves, be regarded as defects.

The rug will be supplied substantially in accordance with the description and images provided in the Auction listing.

Any dimensions, colours, materials or other specifications provided on the Auction website are intended to accurately describe the rug, although minor variations may occur due to photography, screen settings, lighting and the handmade nature of the product.

Nothing in this section limits any rights or remedies available to the successful bidder under the Australian Consumer Law or other applicable legislation.

11. Technical Issues and Auction Integrity

We will use reasonable efforts to ensure that the Auction website operates correctly. However, we do not guarantee that the website or Auction will be available continuously or without interruption.

We are not responsible for delays, interruptions, connectivity issues or other technical problems outside our reasonable control.

Where a technical issue or other circumstance materially affects the fairness or integrity of the Auction, we reserve the right to suspend, extend, restart or cancel the Auction.

We may also remove or invalidate a bid where we reasonably believe it resulted from a technical error, fraudulent activity, manipulation or a breach of these Terms and Conditions.

12. Cancellation or Suspension

We reserve the right to postpone, suspend or cancel the Auction at any time where reasonably necessary, including due to:

  • technical failure;
  • fraud or suspected fraudulent activity;
  • circumstances beyond our reasonable control;
  • an error in the Auction listing;
  • circumstances affecting the availability or condition of the rug; or
  • any other circumstance that may materially affect the proper or fair conduct of the Auction.

If the Auction is cancelled before a binding sale has been completed, any obligation to purchase the rug will be cancelled and no bidder will be liable for their bid.

Where payment has already been received and the sale is subsequently cancelled, any refund will be handled in accordance with applicable law.

13. Responsible Bidding

You are responsible for ensuring that you understand the amount you are bidding and that you have the financial capacity to complete the purchase if successful.

You must not:

  • place bids for the purpose of artificially increasing the price;
  • place bids on behalf of another person without their authority;
  • use multiple accounts to manipulate bidding;
  • interfere with the Auction website or bidding process; or
  • engage in any conduct that may compromise the integrity or fairness of the Auction.

We reserve the right to investigate suspected manipulation or misconduct and take appropriate action, including cancelling bids or excluding a bidder from the Auction.

14. Australian Consumer Law

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights, guarantees, warranties or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.

To the extent permitted by law, these Terms and Conditions apply in addition to any rights you may have under applicable consumer protection legislation.

15. Privacy

Personal information collected through registration and participation in the Auction will be used for purposes including:

  • administering the Auction;
  • processing and confirming bids;
  • contacting bidders and the successful bidder;
  • arranging payment and delivery;
  • administering the charity donation; and
  • complying with our legal and administrative obligations.

Personal information will be handled in accordance with our applicable Privacy Policy.

16. Liability

To the maximum extent permitted by law, we will not be responsible for any loss or damage arising from circumstances outside our reasonable control, including website outages, internet or telecommunications failures, technical errors or interruptions.

Nothing in these Terms and Conditions excludes liability that cannot legally be excluded under applicable law.

17. Dispute Resolution

If you have a concern or dispute relating to the Auction, please contact us in the first instance so that we can attempt to resolve the matter promptly and in good faith.

If the matter cannot be resolved informally, it will be dealt with in accordance with the laws of New South Wales, Australia, subject to any mandatory rights or protections available to you under applicable law.

18. Changes to These Terms

We may update these Terms and Conditions where reasonably necessary.

Any material changes made before the Auction opens will be published on the Auction website.

Once bidding has commenced, we will not make changes that materially disadvantage bidders without reasonable justification and appropriate notice.

19. Acceptance of Terms

By registering for the Auction or placing a bid, you confirm that:

  • you have read and understood these Terms and Conditions;
  • you agree to be bound by them;
  • the information you have provided is accurate; and
  • you have the legal capacity to participate in the Auction.

If you do not agree to these Terms and Conditions, you should not register or place a bid.
